Art Laboratory Berlin freut sich, die vierte Ausstellung der Reihe „Kunst und Recht“ anzukündigen: Die Ausstellung Creative Rights. On Appropriation, Copyright and Copyleft untersucht die Verwendung, Weiterverwendung und den Missbrauchs von Bildern und Informationen in der Gegenwartskunst aus künstlerischer, legaler, politischer und philosophischer Perspektive. Das Ausstellungsprojekt "Creative Rights" präsentiert sich in drei Teilen: die Ausstellung mit vier künstlerischen Positionen, die Creative-Rights-Bibliothek mit ausführlichem Material zu den vorgestellten Arbeiten und anderen aktuellen Rechtsfällen und ein Workshop zum Thema "Copyright".
 
Die Ausstellung zeigt vier künstlerische Positionen, die auf unterschiedliche Weise mit Formen der Aneignung, dem Bereich Fair Use (einer bestimmten Form der autorisierten Nutzung von geschütztem Material) und dem sogen. "Copyleft" (der bewussten künstlerischen Entscheidung, den Schutz des Copyrights zu unterlaufen) umgehen.
 
Triple Candie (ein kuratorisches Duo mit Shelly Bancroft und Peter Nesbett) provozierte eine Kontroverse im Jahr 2006, als sie in ihrer Ausstellung David Hammons: The Unauthorized Retrospective Farb- und S/W-Fotografien aus Büchern, Broschüren, Katalogen und Webseiten verwendeten, um die Arbeit des US-amerikanischen Künstlers David Hammons vorzustellen. Das Ergebnis der Ausstellung, die nun als kuratorisches Zitat in Teilen bei Art Laboratory Berlin erneut präsentiert wird, wirft ein kritisches Licht sowohl auf Hammons Arbeiten als auch auf die Praktiken der Kunstwelt und wurde verurteilt aber auch herausragend gelobt.
 
Die Arbeit Repetitions-Revolutions-Rituals des deutsch-iranischen Künstlers Azin Feizabadi ist Teil eines Projekts, das der Künstler 2004 begann, als er mittels einer Schablone das Bild einer Frau mit Kopftuch in Berlin-Kreuzberg auf Häuserwände sprühte. Die Arbeit, ursprünglich als Hommage an seine Mutter, die als 18-Jährige während der iranischen Revolution politisch kritisches Gedankengut mittels Graffiti in Teheran verbreitete, wurde 2006 von der Zeitschrift Fokus auf der Titelseite mit den Worten "Die Multikulti-Lüge" missbraucht. Feizabadi wird sich dieses Bild auf eine neue Weise (zurück)anzueignen.
 
Die Arbeit The Copyright Piece (2009) von Christian de Lutz befindet sich an der Schnittstelle zwischen Rechtsverletzung und Fair Use, indem sie auf die rechtliche Grauzone aufmerksam macht und sich als Kritik am Finanz- und Kunstmarkt versteht. Das Werk besteht aus einer CD mit einem Klangstück, das durch die starke Bearbeitung und Verzerrung eines Musikstücks entstanden ist. Neben der CD gibt es einen Künstlertext und einen Vertrag, der die Arbeit unter besonderen Bedingungen an Interessenten anbietet.
 
Die Arbeit Planed (2007) des italienisch-britischen Künstlerduos Gilbert and George wird in der Ausstellung als Beispiel für die Praxis des "Copyleft" präsentiert, eine Alternative zur üblichen Praxis des traditionellen Copyright. Die Künstler boten diese Arbeit als neun herunterladbare Dateien über die Webseiten des BBC und des Guardians an. Sie wurde kostenlos an ein breites Publikum ohne irgendwelche Einschränkungen angeboten.
 
Zusätzlich zur Ausstellung gibt es noch die Creative Rights Bibliothek, eine Sammlung an Artikeln, Manifesttexten und Dokumenten, die eine Reihe an Themen zu Copyright und "Copyleft" beinhalten. Dabei werden zwei aktuelle Rechtsfälle von Künstlern hinsichtlich Streitigkeiten des Copyrights präsentiert: Der US-amerikanische Künstler Shepard Fairey, der für sein Obama-Plakat während des US-amerikanischen Wahlkampfes berühmt wurde, ist gegenwärtig in einen Rechtsstreit mit der Associated Press (AP) verwickelt. Der andere Rechtsfall betrifft Richard Prince und den Fotografen Patrick Cariou. Prince benutzte 2008 in seiner aktuellen Collage-Serie Canal Zone Fotografien aus dem Buch "Yes Rasta" von Cariou, der Klage wegen der Verletzung des Copyrights einreichte. Darüber hinaus wird die Bibliothek Materialien über die ausgestellten Künstler sowie Dokumente über das deutsche und US-amerikanische Copyright-Gesetz, die Bewegung Creative Commons, das Stanford University Fair Use Project und die deutsche und schwedische Piratenpartei bereitstellen.
 
Der dritte Teil des Ausstellungsprojekts "Creative Rights" ist der Workshop Urheberrecht und verwandte Themen für Künstler, Musiker, Filmemacher und andere kreative Bereiche (s.o.).

Art Laboratory Berlin is pleased to announce the fourth exhibition in the series Art and Law: The exhibition Creative Rights. On Appropriation, Copyright and Copyleft investigates questions concerning the use, re-use and misuse of images and information in the contemporary art world from artistic, legal, political and philosophical viewpoints. The exhibition "Creative Rights" consists of three parts: The exhibition with four ar-tistic positions, the Creative Rights Library with extensive material on the presented artists and other recent law cases as well as a workshop on the theme of copyright.
 
The exhibition shows four positions offering unique views on appropriation, fair use (a term defining legal use of images outside of copyright restrictions) and 'copyleft'( the decision of the artist to forego the protections of copyright).
 
Triple Candie (curatorial duo Shelly Bancroft and Peter Nesbett) provoked controversy in 2006 with their exhibition David Hammons: The Unauthorized Retrospective in which they exhibited color and black and white copies from books, brochures, catalogues and websites documenting the work of the American artist David Hammons. The resulting exhibition, part of which is on display in "Creative Rights" as a curatorial quotation, cast a unique critical light on both Hammons work and art world traditions, and was both highly praised and criticised.
 
Repetitions-Revolutions-Rituals by the Iranian-German artist Azin Feizabadi documents a project started by the artist in 2004 when he sprayed an image of a woman in a headscarf using a stencil throughout the Kreuzberg district of Berlin. The work, initially an homage to his mother, the artist Farkhondeh Shahroudi, who as an 18 year old during the Iranian Revolution, sprayed left wing graffiti in Tehran, was missused in 2006 by the German glossy newsweekly Focus for its cover, with the words 'The Multi-cultural Lie". Feizabadi has chosen to 'reappropriate' the image in a specific way.
 
Christian de Lutz's work The Copyright Piece (2009) situates itself on the border between infringement and fair use, making reference to this legal gray area, as well as functioning as a critique of both the current financial and art markets. The artwork consists of a CD with a sound piece which the artist created by substantially altering a piece of music. In addition to the CD there is an artist text and a contract, which offers the work to a collector under certain circumstances.
 
Planed (2007) by Gilbert and George, the Italian-British artist duo, is featured in the exhibition as an example of 'copyleft', a chosen alternative to traditional copyright. The artists offered the work as 9 files for download, in cooperation with the BBC and Guardian newspaper. The work was offered for free to the general public, without any stated restrictions.
 
In addition to the exhibition there is the Creative Rights Library, a collection of articles, manifestos and documents covering a number of topics pertaining to copyright and 'copyleft'. It features two current cases of artists in copyright disputes. The American artist Shepard Fairey, known for his now famous Obama campaign posters, is currently in a legal dispute with the Associated Press (AP). The other case is that between Richard Prince and the photographer Patrick Cariou. Richard Prince used photographs from Cariou's book 'Yes Rasta' in his recent series of collages 'Canal Zone'. Cariou filed a lawsuit for copyright infringement. Additionally the library will have materials on the artists in the exhibition as well as material on both US and German copyright law, Creative Commons, the Stanford University Fair Use Project as well as the Swedish and German Pirate Parties.
 
As a third part of "Creative Rights" on Saturday, 28 November at 3 PM Art Laboratory Berlin will also present a workshop on Copyright and Related Themes for Artists, Musicians, Filmmakers and other Creative Professionals (see above).
